The Supreme Administrative Court

Another year has passed, in which the authorities are required to present the Report on the state of the Lubartów City Commune. We wrote on the website www.molubartow.com why the Report is, in our opinion, not very legible. It is difficult to compare year on year when using different indicators.

The document shows that the number of people addicted to alcohol is not decreasing in the city. The number of people obliged to undertake drug addiction treatment has increased. The turnover from the sale of alcohol is increasing. On the one hand - the city earns, on the other - in the city budget, we allocate a specific amount each year to the implementation of the Prevention and Solving Alcohol-related Problems Program.

In 2020 - PLN 445,700.00. Plus counteracting drug addiction, which often go hand in hand - PLN 54,300.00.

Non-governmental organizations can apply for this money. In and out of contests.

The main goal of the Municipal Program for Preventing and Resolving Alcohol-related Problems and Counteracting Drug Addiction for 2019 was to reduce the number of people at risk of addiction and addicted to alcohol and other psychotropic substances, and above all the negative social effects resulting from these phenomena, including preventing domestic violence.

We don't really know if it worked. If the number of alcohol addicts does not decrease, it would be good to know if the proposed actions are the same from year to year. That is why we have submitted an application for disclosure of public information, i.e. copies of applications submitted in the competitive and non-competitive mode for co-financing in 2017-2019  along with a list of granted subsidies and the amount of funds provided. The Office informed us that copies of non-competitive applications are published in the Public Information Bulletin, as are the lists of awarded grants. However, the applications in the competition mode can be viewed on the spot, at the office, if we make an appointment.

We agree that after the competition is adjudicated, there is nothing to prevent us from also publishing them in the BIP. Therefore, after an unsuccessful summons, we filed a complaint with the Provincial Administrative Court. In its decision, the Court did not refer to, inter alia, to the fact that the Office provided us with incomplete information, and for the rest of the requested documents, the Office ordered us to come in person, contrary to what we indicated in the application - in what form it should be provided and our complaint was rejected.

We disagree with the arguments.

That is why the case - through the Watchdog Polska Civic Network Clinic - was brought to the Supreme Administrative Court, to which our attorney filed a complaint.
